Freakhookup Terms of Service

Abbreviated version of the Freakhookup Terms of Service

1. Definitions

a. 'Freakhookup refers to/is defined as the FreakHookup.com website & excludes it owner/operator.
b. 'Data' or 'File' refers to any digital/and or analog document/or information that has the potential to be uploaded to FreakHookup.
c. 'Active User' refers to the individual who uploads files to Freakhookup.com
d. 'url' refers to the location of any file located on Freakhookup server/server's.

2. Terms of Service

Freakhookup reserves the right to remove or replace any uploaded data. Freakhookup assumes no liability for lost files. If you use the Freakhookup service you are responsible for maintaining the confidentiality of your files location on our server (via url).

The following types of data constitute "ABUSIVE ACTIONS" and may not be uploaded to our server under any circumstance.

a) Any person under the age of 18. And in countries where applicable any persons under the age of 21 may not be uploaded to our servers.
b) No simulated art of a person/cartoon or otherwise of someone that may appear to be under the age of 18.
c) Data that infringe on the copyrights of any entity excluding the user thyself.
d) Any files other than photos or flash data.
e) Files that could be seen as promoting or inciting the following: Racism, Bigotry, Hate speech & spam.
f) files that are illegal or in violation of United States or Amsterdam(Netherlands) law.

Uploading 'Abusive' files may result in immediate termination of data, ability to use FreakHookup services (there will be a lifetime ban for the first offense, where a user will be banned by IP address & a data check will be put in place to assure the offending data cannot be uploaded again). Attempting cimcumvention ability to enforce the Freakhookup T.O.S. will result in prosecution.

To report any abusive actions by a user, send e-mail to abuse@freakhookup.com & we will investigate the issue usually within 24-72 hours. We reserve the right to refuse deletion of data if there is not a site-tos or legal reason to do so.

3. Privacy

All data provided by a Freakhookup user is strictly confidential (in that we will not release data openly to the public). We however reserve the right to collect demographic information & to send e-mails of commercial nature to users of our site. We also reserve the right to provide this information to 3rd parties for the purpose of commercial solicitation & demographic sales. By uploading data to Freakhookup you agree to allow these commercial solicitations & allow us to use for ourselves/as well as provide demographic information to a 3rd party for commercial purposes.

4. Indemnity

User agrees to indemnify and hold Freakhookup harmless from any liability, claims, loss, expenses and damages, including attorney fees, which come from or related to the content, user, or deletion of data or use of any other features of freakhookup. This includes:

- User's responsibility of any & all liability arising from the violation of infringement or proprietary rights or copyrights.
- Any defamatory, hate crime or unlawful material contained within the user's Data.

5. Law Enforcement

Freakhookup fully supports Freedom of Speech & the rights of its user's to express themselves in any way they choose. However if a user uploads an illegal image (As per United States law), we will fully cooperate with any law enforcement agency to track this user down, including but not limited to:

- Supplying all server logs & any information we have on such User.

Law enforcement is encouraged to contact Freakhookup staff at le@freakhookup.com Please include a brief description of the offending user/data, a url to said data, and be sure to include the agency you represent/e-mail contact/phone number/ first initial & last name. We fully support law enforcement operations when it comes to illegal content & we will cooperate to extreme measures to help such agencies track down offending users.
